Terms of Use – Fanto Studio

1. Scope

These Terms of Use apply to all contracts between Fanto Studio, operated by Susanne Klaus, Marienstraße 9, 10117 Berlin, hereinafter referred to as the “Provider”, and users of the platform www.fanto.work/studio and its associated services.

2. Services Provided by Fanto Studio

Fanto Studio offers an AI-based image generation service that creates professional application and portrait photos from uploaded images. The service includes:

• Photo upload by the user
• Selection of desired styles
• AI-powered image generation
• Delivery of final images in various formats

There is no guarantee of a specific visual result. The generation process is based on algorithms and optimized within technical possibilities.

3. Conclusion of Contract

A contract is concluded when the user:

1. Selects a package
2. Submits the required data and images
3. Completes the payment
4. Accepts these Terms of Use

The Provider reserves the right to reject orders without giving reasons (e.g., due to inappropriate image material).

4. Requirements for Use

The user is responsible for uploaded content. This must not infringe the rights of third parties, especially personal rights, copyrights, or trademark rights. The service is only available to users who are of legal age.

5. Prices and Payment

All prices are in euros and include VAT. Payment is made through the payment providers listed on the website. Service delivery starts after receipt of payment.

6. Copyright and Usage Rights

After completion, the user receives a simple, non-exclusive, unlimited license to use the generated images for private and professional purposes (e.g., job applications, LinkedIn, social media). Redistribution or commercial resale (e.g., stock photo sales) is not permitted without explicit written consent.

7. Liability

Fanto Studio is not liable for:

• The visual result of the image generation
• Data loss due to faulty uploads
• Use of the images by third parties after download

The Provider is only liable for slight negligence in cases of breach of essential contractual obligations (cardinal duties), limited to foreseeable, contract-typical damage.

8. Right of Withdrawal

Since this is a personalized digital service, the right of withdrawal expires as per § 356 (5) BGB once execution begins, provided the user has expressly agreed.

9. Data Protection

Personal data is processed in accordance with our Privacy Policy. Uploaded images are stored solely for the purpose of processing and generation and are deleted after a defined period.

10. Final Provisions

Should any provision of these Terms be or become invalid, this shall not affect the validity of the remaining provisions. German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction, where legally permissible, is the registered office of the Provider.
